Jurisdiction

The Mine Act grants MSHA jurisdiction over "coal and other mines" that have “products … which enter commerce” or “operations or products …which affect commerce.” At other types of operations, MSHA does not have authority to inspect, enforce and penalize. Under the Occupational Safety and Health Act, OSHA has jurisdiction these other "workplaces.” Lang Brothers, Inc., 13 FMSHRC 413 (October, 1991).
